E-SHOP RULES

These e-shop rules (hereinafter – the Rules) is an integral and mandatory part of the sale and purchase agreement entered by the electronic shop www.numiset.com (hereinafter – the Seller) and the customer (hereinafter – the Buyer) providing information regarding terms and conditions of the sale and purchase of the electronic shop and determining rights and obligations of the Seller and the Buyer regarding selling and purchasing goods in the electronic shop.

I. GENERAL PROVISIONS

1. The following persons shall have the right to purchase from the e-shop:
1.1. legally capable natural persons, i.e. adults (18 and older);
1.2. minors aged 16–18, only with consent from their parents or guardians, except in cases when they dispose of their income on a self-dependent basis;
1.3. legal entities;
1.4. authorized representatives of all persons mentioned above.
2. The Buyer has to choose one of the following ways to use services of the e-shop:
2.1. purchase with registration;
2.2. purchase without registration.
3. Personal data submitted by the Buyer (name, surname address, phone, e-mail) while registering in the e-shop are stored; however, collected data is not shared with the third parties.
4. Prices for items indicated in the e-shop catalogue are valid only in this e-shop. Delivery fee is not included – it is indicated separately before the confirmation of the order and it is separated in the confirmation of the order.
5. When the Buyer places the items in shopping cart, identifies delivery address, chooses payment method and gets acquainted with these Rules (reads and clicks “I have read and agree with the Rules”) in the e-shop it shall be considered that the Buyer and the Seller have entered into the purchase and sale agreement.

II. RIGHTS AND OBLIGATIONS OF THE BUYER

6. The Buyer can choose and order any item from the catalogue of the e-shop.
7. When the Buyer uses services of the e-shop it shall be considered that the Buyer agrees with these Rules and is obliged to follow them.
8. The Buyer has to submit detailed and correct data in registration form of the e-shop. In that case if the personal data of the Buyer has changed and the Seller was not informed about that, it shall be considered that the Buyer takes all the risk of loses caused by this fact.
9. It is forbidden to register and use services of the e-shop several times for the same person while using different names.
10. The Buyer undertakes not to share registration and login data with the third parties. The Buyer has to inform the Seller by e-mail at info@numiset.com in that case if the Buyer losses login data. The Seller is not responsible for the actions of the third parties using login data of the Buyer.
11. The Buyer has to be in specified place on specified time and accept ordered items.
12. The Buyer is responsible for all actions while using the e-shop.
13. The Buyer is committed to follow these Rules.

III. RIGHTS AND OBLIGATIONS OF THE SELLER

14. The Seller is committed to accept returned items by the Buyer under conditions established by these Rules.

15. The Seller has the right to cancel the order without warning in advance the Buyer in that case if the Buyer does not pay for the order by the determined payment method during 2 (two) business days.
16. The Seller has the right to contact the Buyer while using information submitted in the order in that case if any uncertainties occur. In this case the delivery time is counted from the day of contact to the Buyer. The Seller has the right to cancel the order without warning in advance:
16.1. if the Seller fails to contact the Buyer during 2 (two) business days after submission of the order;
16.2. if the Buyer does not provide information asked by the Seller during the period identified by the Seller;
16.3. if the Seller does not get the consent to check personal data of the Buyer.
17. The Seller has the right to cancel the registration and delete data of the Buyer or restrict the right to use services of the e-shop if false, inaccurate, misleading or incomplete data is submitted during the registration or the Buyer does not follow obligations determined in these Rules. Only the Buyer is responsible for the consequences caused by false data submitted by the Buyer.
18. The Seller reserves the right to stop or cancel the registration of the Buyer and usage of services of the e-shop without warning in advance in that case if there are grounds for believing that the Buyer acts illegally or attempts to undermine the work or stable activity of the e-shop.
19. In that case if the Seller is not able to deliver ordered item due to unforeseen circumstances, the Seller is obliged to offer an analogue or similar item. If the price of the offered analogue or similar item differs from the initial price, the Buyer has to pay the difference or the Seller has to refund the difference to the Buyer. If the Buyer refuses to accept the analogue or similar item, the Buyer is obliged to reimburse the Buyer within 14 (fourteen) business days if the payment was made in advance and cancel the order in all cases.
20. The Seller is not responsible for actions of the third parties using banking system of the Buyer and entering sale and purchase agreement while using services of the e-shop.
21. The Seller is obliged to provide all necessary conditions for the Buyer to use services of the e-shop.
22. The Seller is obliged to respect privacy of the Buyer. The Seller is obliged to operate private data of the Buyer only under terms and conditions determined in these Rules and Privacy Policy.

IV. PAYMENT FOR ITEMS

23. The Buyer shall pay for the selected items:
23.1. via online banking system.

V. DELIVERY OF ITEMS

24. After the order is confirmed, the items are prepared for sending during 1-3 business days and the Seller is obliged to deliver items to the courier service.

25. The Seller is discharged from the liability regarding the breach of time limits on delivery of the items in that case if the items are not delivered or are delivered not on time due to the fault of the third parties or circumstances related to the Buyer.
26. The Buyer is committed to accept the items. While accepting the items it is necessary to provide valid identity document (personal identity card, passport or new model driving license). If the Buyer can not to accept the items personally, despite the fact that they are delivered on address identified by the Buyer, the Buyer has not the right to raise any claims against the Seller regarding delivery of the items to wrong person.
27. The legal representative of the Seller (post or courier services) will deliver the items. After the Buyer signs consignment note, it is considered that the items are transferred (delivered) properly.

28. The Buyer has to check the state of the item during the delivery of the item together with the legal representative of the Seller. The Buyer has to mark in the consignment note and fill in free form description if the consignment is damaged.
29. Delivery fee is not included in price of the item in the e-shop – it is indicated while following paragraph 4 of these Rules.

VI. RETURN OF ITEMS

30. The Buyer has the right to terminate purchase and sale agreement without identifying the reason during 14 (fourteen) days while informing the Seller by email at info@numiset.com.
31. In that case if the Buyer informs the Seller about the termination of purchase and sale agreement within 14 (fourteen) days from the day of the item delivery, the item has to be returned in original packing (labels are intact, protective film still covering the item and etc.). The item should be not used and damaged; it should be clean and its commercial appearance should be not damaged; also, the item should be properly prepared and packed.
32. In order to return the item, the Buyer should submit request and identify detailed information regarding the order: order number, date, item, price, date of delivery. Also, bank account, where money should be returned, should be identified in the request.

33. The Buyer has to discuss the way of returning items (all the issues regarding picking up the item, transporting it to the place identified by the Seller) with the Seller via e-mail during 3 (three) business days after termination of the agreement. In this case the Buyer has to return the item complying the requirements determined in paragraph 31 of these Rules. After termination of the agreement, money paid for the item will be returned during 14 (fourteen) business days from the day of returning the item.
34. The Buyer shall bear the expenses of the return of the item in that case if the Buyer terminates agreement.

35. The Buyer has not the right to terminate purchase and sale agreement in that case if:
35.1. if the Buyer damaged or changed significantly the appearance of the item.

36. The items shall be returned by using courier services.

VII. FINAL PROVISIONS

37. The Seller reserves the right to terminate, amend or change these Rules or other documents related to these Rules while informing the Buyer about this fact in the e-shop. Amendments and changes of these Rules shall be applicable from the day of the publication of amendments in the e-shop system.

38. If the Buyer uses further the e-shop services after the change of these Rules, it shall be considered that the Buyer agrees with the new recast, changes and amendments of these Rules.
39. All disputes related to the implementation of these Rules shall be settled by negotiation. In the event of failure to reach an agreement during 30 (thirty) days, any disagreements shall be settled according to the procedure established by laws.
